地方性法规立法后评估的实践探索——以《甘肃省水土保持条例》为例

摘要
立法后评估既是检验立法质量的重要手段,又是促进立法不断趋于完善的重要方式。通过立法后评估对地方性法规进行检视,不仅具有重要的理论意义,而且对地方性法规的立、改、废有现实指导作用。本文以《甘肃省水土保持条例》立法后评估为例,结合具体实践,从评估主体的选择、评估标准的确定、评估方法的采用、评估结论的转化等多个角度,考察我国地方立法机关在立法后评估工作中所做的探索。通过对《甘肃省水土保持条例》文本质量和实施效果的评估,尝试对完善立法后评估工作提出针对性建议:即通过构建常态化的评估机制,确立科学的评估标准,创新和完善评估方法等途径来增强评估结论的科学性、可靠性,确保立法后评估真正发挥实效,服务于地方法治建设,有序推进地方立法质量和立法水平的提升。
Post-Legislation evaluation is not only an important method of testing the quality of legislation,but also an important way for legislation improvement. Thus. the inspection of local regulations through post-legislation assessment has both important theoretical and practical significance as it guides the establishment, revision and abolition of local regulations. This article takes the post-legislation assessment of the Regulations of Gansu Province on Soil and Water Conservation as an example. Based upon this example,this paper assesses the post-legislation evaluation work by local legislatures from the following aspects: the selection of evaluators, determination of assessment criteria, adoption of assessment methods as well as transformation of assessment conclusions. Moreover,this paper attempts to improve this Regulation through examining its quality and implementation effects. Meanwhile,this paper aims to summarize the experience of postevaluation of this Regulation and put forward corresponding measures and suggestions for general postevaluation work of legislations. In other words,this paper aims to strengthen the quality and reliability of assessment outcomes, ensure the effectiveness of post-legislation evaluation work,and ensure the benefit of post-legislation evaluation to the local development of rule of law. It also attempts to promote local legislation quality and levels through the construction of a normalized assessment mechanism, establishment of scientific assessment standards, innovation and improvement of assessment methods, and so on.
