摘要

警察执法中的权利保障和权威维护是相辅相成的。公民权利的保障离不开警察权威的维护,警察权威的维护也离不开公民权利的保障。可以说,不以维护警察权威为基础的公民权利难以得到充分而有效的实现,而不以公民权利保障为前提的警察权威难以实现真正的塑造。然而,当前警察执法中存在权利保障内容的不充分性、权威维护方式的非正当性以及权利保障与权威维护的非平衡性等结构性失衡。完善警察执法需要遵循"塑造执法理念——规范执法行为——建立保障机制"的治理进路。首先在辨证理解权利保障与权威维护的基础上实现警察执法理念的重塑;其次通过执法规范对执法行为的规制实现警察执法行为的实践运作,最终在机构设置和程序设定的前提下健全警察执法权威的综合保障机制。
        The protection of rights and the maintenance of authority in police law enforcement are mutually reinforcing. The protection of civil rights is inseparable from the maintenance of police authority,and the maintenance of police authority is inseparable from the protection of civil rights. It can be said that it is difficult to achieve full and effective realization of civil rights based on the maintenance of police authority,and it is difficult for police authorities who are predicated on the protection of civil rights to achieve true shaping. However,in the current police law enforcement,there are structural imperfections such as the inadequacy of rights protection,the unjustifiedness of authoritative maintenance methods,and the non-equilibrium of rights protection and authority maintenance. To improve police enforcement,we need to follow the governance approach of "shaping the concept of law enforcement – standardizing law enforcement behavior – establishing a safeguard mechanism". Firstly,on the basis of dialectical understanding of rights protection and authoritative maintenance,the concept of police law enforcement was rebuilt. Secondly,the law enforcement norms regulate the law enforcement behavior to realize the practice of police law enforcement behavior. Finally,a comprehensive guarantee mechanism for law enforcement authorities can be established under the premise of institutional setting and procedure setting.
