摘要

"三权分置"模式下,农村承包地存在3种不同的权利流转状态:土地承包经营权的整体流转、土地经营权的初次流转和土地经营权的再流转。基于自身特性,土地经营权的再流转有其独特的方式和流转风险。土地经营权再流转的方式包括出租、入股、抵押、质押等,再流转的风险包括农地无限流转与过度资本化、过度集中与流转违约、"非农化"与"非粮化"等。在明晰再流转方式的基础上,可尝试采取规制再流转受让主体、限制土地持有数额、强化农地用途监管等措施,以期实现土地经营权再流转风险的制度防范。
        Under the model of "Separation of Three Powers", there are three different states of right circulation on rural contracted land,including the overall transfer of land contractual management rights, the initial transfer of land management rights, and the re-transfer of land management rights. Based on its own characteristics, the re-circulation of land management rights has its own unique ways and turnover risks. The ways of re-circulating land management rights include rent,shareholding, mortgage, pledge, etc. The risks of re-circulation include unlimited circulation and excessive capitalization of agricultural land, excessive concentration and circulation default, "non-agriculturalization" and "non-food". On the basis of clarifying the re-circulation mode, it is possible to try to adopt measures such as regulating and re-transfer the transferee,limiting the amount of land holding, and strengthening the supervision of agricultural land use, in order to realize the system prevention of the risk of re-circulation of land management rights.
