中美民办高校立法的比较研究

摘要
我国民办高等教育的迅速发展过程中,相应的一系列问题也凸显出来,特别是规范民办高等教育的相关法律法规的缺失成为影响和制约民办高等教育的关键所在。本文以民办高等教育的相关立法为研究对象,分析我国现有的民办高等教育的相关立法,比较立法较为完善、私立教育发展最快的美国的相关立法法规状况,阐明法律法规对一国民办高等教育事业发展将产生最为重大的影响,特别是对于正处在发展初期的我国,立法水平上的差距直接决定了整个民办高等教育发展水平上的差距。最终为探索适合我国社会文化背景的个性化发展道路作出努力,以期能够对相关立法的完善,乃至整个民办高等教育事业的发展尽一份力量。
本文主要分为以下四部分:
第一部分是对中美两国民办高等教育的立法现状的比较研究,本部分通过对我国民办高校的立法现状的梳理,与美国比较完善的私立学校的立法现状进行对比,揭示我国民办高校相关立法的严重不足,并试图对我国民办高校法律规范的完善以及法律体系的建构提出可行性建议。
第二部分主要论述了民办高校的法律地位问题。本部分通过中美两国民办高校的法律地位的阐述,揭示出我国民办高校的法律地位规定较为模糊,实际可操作性不强,从而造成民办高校的权利义务不明确,最终影响我国民办高等教育事业的发展进步,并在此基础上提出了进一步明确我国民办高校法律地位的建议。
第三部分主要论述民办高校的产权归属问题。本部分通过中美两国民办高校产权归属的立法现状进行比较,揭示出我国民办高校产权归属问题立法规范较为模糊,以美国的相关法律规范为启示,试图建构适合我国民办高校发展的产权立法体系。
第四部分主要论述民办高校的管理制度问题。由于我国民办高校发展较晚,相关的管理制度还不够完善,民办高校的法人制度并不健全。因此,本部分通过与美国私立学校的管理制度相关立法的比较研究,对完善我国高校内部管理制度提出可行性建议。
文章最后得出结论,民办高校的法人地位不仅应在原则上予以规定,更应通过法律法规保障其在实践中的可操作性;民办高校的产权界定必须明确具体,特别是对举办人的合理收益问题应通过法律予以确定,以此鼓励投资者的投资情绪;民办高校的科学管理决定其最终的发展和生存,因此完善的、以法律加以明确的法人治理模式应在民办高等学校中予以切实推广实行。总之,良好的法律法规将是保障民办高等教育健康有序发展的前提和基础,在这条道路上我们仍然任重道远,通过比较借鉴美国等民办教育发达国家的立法经验,为探索适合我国社会文化背景的个性化发展道路作出努力。
With the rapid development of private higher education, corresponding problems highlighted, in particular, the absence of relevant laws and regulations of regulating private higher education make the key constraints of private higher education. In this paper, the relevant legislation for the private higher education study, analysis of the existing private higher education in the relevant legislation, comparative legislation better, the fastest growing private education legislation and regulations related to the U.S. position clear on a country's laws and regulations for private higher the development of education will have the most significant impact, especially for our country is in the early stage of development, the gap between the level of legislation directly determines the level of Private Higher Education in the gap. Ultimately exploring social and cultural background of the individual path of development efforts with a view to the improvement of relevant legislation, and the whole development of private higher education make a contribution.
This paper is divided into four parts:
The first part is a Sino-US status of private higher education comparative study of legislation, this section on the legislative status of Private Colleges and Universities combing, and the United States more complete legislative status of private schools compared to reveal the relevant legislation in Private Colleges and Universities The serious shortage of Private Colleges and attempted to improve the legal norms and legal system construction of the feasibility of proposals put forward.
The second part discusses the legal status of private universities. This part of the two countries by the legal status of private colleges described, revealing the legal status of private universities is more vague provisions, the actual operability is not strong, resulting rights and obligations of private universities is not clear, the ultimate impact of private higher education career development and progress, and on this basis is proposed to further clarify the legal status of the recommendations of private universities.
The third part discusses the problem of the property ownership of private universities. This part of the Sino-US private universities through the legislative status of property rights vested in comparison reveals that the issue of property ownership of private universities is more vague legislative norms, laws and regulations related to the United States for the inspiration, trying to construct for the development of China's Private Colleges and Universities system of property rights legislation .
The fourth part discusses the problem of the management system of private universities. Since the development of private universities in China later, the relevant management system is still not perfect, private college is not a sound legal system. Therefore, this part of the management of private schools through the system with the United States A Comparative Study of the relevant legislation, to improve the internal management system of universities make feasible suggestions.
Finally, to conclude that the legal status of private universities should not only be in principle the provisions of laws and regulations should be adopted to ensure their operability in the event; private universities must be clear and specific definition of property rights, in particular, is held to the reasonable Revenues should be determined by law, to encourage investor sentiment; the scientific management of private universities to determine their final development and survival, so perfect to be a clear legal corporate governance model should be effective in the private higher education institutions promotion practice. In short, a good protection of the laws and regulations will be healthy and orderly development of private higher education and basic premise, in this road we still have long way to go, learn from the United States in comparison, the legislative experience of developed countries, private education, to explore for our society cultural background, personal path of development efforts.
本文主要分为以下四部分:
