美国政府采购监督机制研究
摘要
政府采购是当今国际贸易自由化和经济全球化发展的产物,是世界各国政府管理社会经济生活的一个重要手段。加强政府采购监督是政府采购工作的一项重要环节,是实现政府采购健康运行的一项基本前提。
纵观当今发达国家,美国是政府采购发展的历史最为悠久、体系最为完善的国家之一。美国政府采购的监督机制,从1761年颁布《联邦采购法》以来,已经经历了从缺乏监督到启蒙发展,再到现在的全面健全三个阶段。美国联邦政府采购的主要监督机构联邦会计总署和行政管理与预算局也在不断的发展和完善。因而,在借鉴美国政府采购两百多年来历史发展的成功经验基础上,对我国政府采购监督机制中存在的一些问题加以总结并提出相应的建议,是一项很富有现实意义的课题。
文章重点论述了美国政府采购的监督机制。详细阐述了美国政府采购监督体系的形成、发展和监督机构的历史演变,介绍了美国政府采购监督机制的历史沿革;重点分析了美国政府采购监督机制健全的政府采购法律法规、成熟的政府采购监督管理机构、相互制约的政府采购监督体系等三大特点;详细地归纳了美国政府采购监督管理机制的核心制度。通过对美国政府采购监督机制的详细分析和充分阐述,推论出对我国的启示。从构建权责明确的监督审查体系、完善政府采购监督法律体系、加强对采购过程的程序监督、完善权利救济制度四个方面提出了建立和完善我国政府采购监督机制的对策和建议。
Today's international trade liberalization and economic globalization brings about government procurement, which is an important approach for the governments to manage social and economic life. Strengthening supervision is an important section of government procurement. Appropriate supervision is also a basic premise to achieve the healthy operation of government procurement.
In today' s developed countries, the United States is one of the countries that the own the longest history and the most perfect system of the government procurement. Since "federal procurement law" was enacted in 1761, The U. S. government procurement supervision mechanism has already experienced three stages: from the stage lack of supervision to the initial enlightenment stage, to the current all-around comprehensive stage. The main supervision body of the U. S. federal government procurement--- the Federal General Accounting Office and Executive Management and Budget Bureau are also in constant development and improvement. Thus, the author uses for reference th"e successful experience of U. S. government procurement, which experiences 200 years of historical development. In this thesis, a number of problems existing in China's government procurement supervision mechanism are concluded and some relative suggestion is put forward. Therefore, it is a subject full of practical significance.
The thesis focuses on U.S. government procurement supervision mechanism. From the perspective of the historical evolution of the supervision mechanism and the historical development of supervision body, the history of the U.S. government procurement supervision mechanism is introduced. Moreover, the thesis highlights the three major characteristics of U.S. government procurement supervision mechanism: sound government procurement laws and regulations, mature supervision of government procurement management institutions, mutual restraint of government procurement monitoring system. After analyzing the U. S. government procurement supervision mechanism and fully expounding, it shed light on China' s procurement supervision mechanism. In order to construct and perfect China' s government procurement supervisory mechanism, the author raises strategies and recommendations from four aspects: constructing a clear supervision powers and responsibilities; improving the government procurement supervisory legal system; strengthening procedures for monitoring the procurement process; perfecting the relief system for the rights.
纵观当今发达国家,美国是政府采购发展的历史最为悠久、体系最为完善的国家之一。美国政府采购的监督机制,从1761年颁布《联邦采购法》以来,已经经历了从缺乏监督到启蒙发展,再到现在的全面健全三个阶段。美国联邦政府采购的主要监督机构联邦会计总署和行政管理与预算局也在不断的发展和完善。因而,在借鉴美国政府采购两百多年来历史发展的成功经验基础上,对我国政府采购监督机制中存在的一些问题加以总结并提出相应的建议,是一项很富有现实意义的课题。
