修改《中华人民共和国体育法》的若干理论问题研究
摘要
《体育法》的修改已经提到了议事日程，研究修改《体育法》的基本理论问题，对于推动《体育法》的修改进程，建立起与社会主义市场经济发展相适应，满足体育发展需求的《体育法》，具有重要意义。
论文主要采用了文献综述法、专家访谈法、分析法等方法。首先从现行《体育法》具有的历史局限性、《体育法》颁布以来体育的发展变化、世界体育法发展的趋势、应对WTO和成功举办奥运会的需要等几个方面论证了《体育法》修改的必要性。其次通过对修改《体育法》的法律基础、理论基础、体制基础、程序基础等方面的分析，探讨了修改《体育法》的可行性。再次，对修改《体育法》的总体思路进行了研究，认为现时应该全面修改《体育法》，不仅要增减条款，而且要调整篇章结构；并应当以“保护权利”作为《体育法》修改的立法本位，明确政府、体育社会团体、市场在体育发展中各自的活动区间，修改过程中要借鉴国外先进的体育立法经验等。第四，提出了《体育法》的具体修改建议，认为现行《体育法》的体例结构应该从新设计，应该增设体育行政机构、体育市场、体育对外交流与合作、体育纠纷裁决方式等章节，并对部分章节的内容进行了初步构建。最后对修改《体育法》的立法技术进行了探讨。
通过研究得出的主要结论是：现时修改《体育法》十分必要，基本具备了修改《体育法》的理论基础，体制基础、法律基础等，但对《体育法》修改的准备工作做的不够充分；现行《体育法》应该全面修改，以“保护权利”作为此次修改的立法本位，明确政府、社团、市场在体育领域中的各自的活动区间；构想出了《体育法》的体例结构和部分章节的内容。
The revision of "Sports Law" already mentioned the agenda, the paper study the elementary theory question about the revision of "Sports Law". It is the vital significance to impel "Sports Law" the revision advancement, adapt with thesocialist market economy development, meet the sports development.
The paper has mainly used literature method , expert talking method and analytic method. First ,this paper proved the necessity which "Sports Law" revises on several aspects , such as the historical limitation which has since present "Sports Law", "Sports Law" promulgates the sports development change, the world sports law development tendency, should to WTO and the success holds the Olympic Games . Second , this paper analyzes the feasibility about the revision "Sports Law" on legal oundation, rationale, system foundation, procedure foundation .Third, studied the overall mentality to carry on revising "Sports Law", thought that "Sports Law" need to revise comprehensively , must take "the protection right"as the legislation standard about "Sports Law" revision, and make it clear about the government, the sports social group, the market in the sports development respective active sector, in the revision process needs to profit from the overseas advanced sports legislation experience and so on. Fourth, propose
d "Sports Law" the concrete revision suggestion. Finally to revised "Sports Law" the legislation technology has carried on the discussion.
The main conclusion obtains which through the research is: Now revises "Sports Law" extremely essential, basically has had revises "Sports Law" the rationale, the system foundation, the legal foundation and so on. Present "Sports Law" should comprehensively revise, this revision took "the protection right" as the legislation standard . Conceived "Sports Law" style structure and partial chapters content.
