摘要

本文行文3.5万余字，分三个部分对劳动教养刑法化进行了探析。
     第一部分：劳动教养刑法化与我国劳动教养制度改革。首先分析介绍劳动教养刑法化涵义、性质以及世界性刑法化改革运动与非刑罚方法兴起情况，接着阐述了我国劳动教养制度性质、现状及存在问题，最后在此基础上论述了劳动教养制度改革出路在于劳动教养刑法化，并进一步探讨了劳动教养刑法化的必要性及意义。
     第二部分：劳动教养刑法化根据。分别阐明了劳动教养刑法化理论上的根据、现实上的根据和法律上的根据。其理论根据主要从防卫社会的现实使命，刑事责任多元化，犯罪类型多样化等方面进行说明。现实根据主要从物质基础、观念基础和外部环境等几方面论证说明了劳动教养刑法化条件基本具备，时机已基本成熟。并对其法律根据进行了分析说明。
     第三部分：我国劳动教养刑法化制度构造。在对劳动教养刑事立法化三种模式进行比较分析的基础上，阐述了只有单独立法才是对劳动教养刑事立法化模式的科学定位。又从法的名称、法的内容几个方面对劳动教养刑事立法化进行了设计，从而对劳动教养刑法化进行了较为理想的构思。
The article with over 35,000 words probes the criminal lawization of reeducation-through-labor.
    Part 1: the criminal lawization and the reformation of reeducation -through-labor in our country .firstly,this part analyses the concept and characters of reeducation-through-labor,reformation campaigh of criminal lawization in the coorld.and rising nonpunishment method.secondly,it sets forth the characters,present situations and existing problems of reeducation-thrugh-Iabor system in our country.lastly,on the basis,the author elaborates that the outlet of reformation of reeducation-through-labor Use in its criminal lawization.Furthermore,it probes the necessibility and significance of criminal lawization.
    Part 2:the basis of criminal lawization of criminal lawization.they are theoretical bases,actual bases and legal bases .the theoretical bases are explained from actual tasks to guard the society,various styles of criminal responsibilities and diversification types of crime.the actual bases principally elaborates the aJmost mature conditions and opportunity of criminal lawization of reeducation-through-labor.The legal bases are analysed in the same part,too.
    Part 3 :the structure of the system of criminal lawization in our country.on the basis of comparing and analyzmg,this part states the scientific location for the style of criminal lawization of reeducation-through-laborHt should be cegislated separately.The author has designed the criminal lawization of reeducation-through-labor from sweral aspects such as tlie law's name,content,etc.As a resuil,the author made an ideal composition
