澳门房产抵押权实现的法律问题研究

摘要

房产抵押权的实现，其实质是指房产抵押权人在债权已届清偿期
    而债务人不履行债务时，处分房产产权以优先取得受偿的行为。房产
    抵押担保的目的在於确保债权的实现，抵押担保债权的实现是房产抵
    押权担保功能实行的最终环节，也是房产抵押权制度的核心内容之
    一。房产业是澳门的主要支柱产业之一，在澳门整体经济中占有相当
    重要的地位。房产抵押权的实现与否不仅涉及到经济的兴衰问题，甚
    至会涉及於整体社会政局的安危。营建一个安全有序和谐的社会环
    境，保障整体经济的持续增长，改善广大民众生活质素，是刚组建的
    澳门特区政府所致力的目标。房产抵押权的实现对促进这一目标的实
    现，大有裨益。
     历史的原因，语言文化的隔阂，澳门的房产抵押权的实现确存在著
    一些亟待解决完善的法律问题，澳门房产抵押权实现的法律问题已摆
    在目前特区政府的议事日程上。身为经济法研究生的澳门人，将此作
    为研究课题是责无旁贷的。
     本文简述了抵押权的概念、性质和特徵以及房产抵押的特点和作
    用，澳门抵押立法历史、现状及其存在的问题，并运用比较的方法将
    澳门的房产抵押制度的部分内容与中国的相关部分逐一比较。意在对
    澳门房产抵押权实现若干法律问题的比较研究中，为澳门现存的房产
    抵押权实现作了一些法律思考，试图为澳门房产抵押权实现问题的解
    决找出些理论依据和施行的手段。
     文章包括以下几个部分：
     第一章：房产抵押概述
     第二章：房产抵押权实现的前提和基础
     第三章：房产抵押权实现的条件和方式
     第四章：房产抵押权实现的效力范围
     第五章：与房产抵押权实现有关的法律问题
     第六章：澳门房产抵押权实现的难题
     第七章：完善澳门房产抵押权实现的法律思考
     随著香港、澳门的顺利回归，台湾问题的谈判也是大势所趋；中
    国大陆改革开放的不断深化，两岸四地的经贸往来日益频仍，在房产
    抵押权实现中不同法域的碰撞冲突日趋明显，因此，以比较法的眼光，
    认真地研究房产抵押制度中的异同处，以增进了解，互补长短。这对
    各地不同法域的房产抵押权制度的进一步认识和完善，甚有必要；对
    中国整体经济的稳定发展和中国统一大业的完成，也都有积极的促进
    作用。
The implementation of house property hypothecation in essence means a
    
     juridical act that pledgee will regard house property right as a debt
    
     preferentially when debtor doesn fulfill obligation in the expiry of paying
    
     bill on credit sales. The purpose of house property hypothecation guarantees
    
     lies in ensuring the implementation of obligatory right. The implementation
    
     of hypothecary guarantee obligatory right is the final link that can exercise
    
     the function of hypothecation and also is one of the cores content of the
    
     hypothecation system. The house property industry is one of the pillar
    
     industries of Macau that occupies considerably important position in the
    
     whole economy of Macau. The implementation is not only related to the
    
     economic vicissitude problems, but also related to the safety and danger of
    
     the whole social political situation. To establish a safe, ordered and
    
     harmonious social environment, ensure a steady increase of the whole
    
     economy and improve the quality of the people life are the goals for which
    
     the government of Macau Special Administrative region have to endeavor.
    
     The implementation of house property hypothecation is beneficial to the
    
     realization of promoting these goals.
    
     Due to the historical reason and language barrier, there are some law

     These have been
    
     placed on the agenda by the government of Macau Special Administrative
    
     Region. As a Macanese and postgraduate in the economic law, it should be
    
     regarded as a question of study, and there is no shirking of my responsibility.
    
    
    
    This paper tends to simply introduce the concept, nature and
    characteristics of hypothecation, and the feature and effect of house property
    hypothecation, and the history, present situation and existing problem of
    hypothecary legislation of Macau. Part of contents of house property
    hypothecation system is compared with those of China. The purpose is the
    thinking of law is done for the existing house property hypothecation of
    Macau, in the comparative study of some law problems. Through the study,
    the author tries to find out the theoretical basis and measures to resolve the
    current problems existed in the hypothecary system.
