中国罪犯的权益保障研究
摘要
我国《监狱法》详细规定了罪犯的基本权利,但是由于各种原因,罪犯权利在实际操作过程中不能很好的得到落实。本文就罪犯权利实现的现状及其相关概念做了简单的介绍,并对保障罪犯权利的实现提出了自己的观点。
保障罪犯权利在监狱工作中占有十分重要的地位,并且取得了无可争辩的进步与发展。但在新的历史条件下,罪犯权利不仅凸现为监狱工作法治化的命题,而且在国际人权斗争中,扮演着重要的角色。
保障罪犯的权利,最终是为了保护所有人的权利。因而保护罪犯权利的实现,是法律赋予监狱人民警察的一项极其重要的任务。我国通过立法的形式,规范执法人员行为,确保罪犯权利的实现。从社会关系和社会地位的角度看,除了被判处死刑立即执行的以外,一个人沦落为罪犯,被判刑入狱,无疑是悲惨境况中最悲惨的了。这些罪犯实施了严重的危害社会的行为,触犯了刑法,依法受到刑罚处罚,被判刑入狱,这是罪有应得,对这一点不应当有任何怀疑。但是另一方面,由于罪犯的社会地位,他们特别容易受到伤害,他们依法享有的权利特别容易受到侵犯。因此,对他们权利的保护也就具有了极其特殊的意义。在这个意义上可以说,对罪犯权利的保护,是人权保障的最后一道屏障。只有罪犯的权利得到有效的保障,所有人的人权才有最终的切实的保障。
The“Prison Law”has stipulated criminal’s basic right in detail. But as a result of kinds of reasons, the criminal right cannot be well carried out in the actual operation process. This article not only gives a briefly introduction of the criminal right realization situation and its correlation concepts, but also offers the opinion on safeguard the criminal right to realize.
Safeguard criminal right hold a very important status in the jail work, and has made the indisputable progress and development. But under the new historic circumstance, criminal right not only in relief for the jail work government by law proposition, but also plays a important role in the international human right struggle. The purpose of safeguard criminal right is to protect all person’s right. Therefore, the realization of protection criminal right is the vital duty that law entrusts with the jail police. In our country, the legislative form standards the officials behavior, guarantees the criminal right realization. From the view of social relations and social positions, besides the direct death penalty, a person who be sentenced in jail is the most pitful. A criminal who implemented the serious harm to the society, has offended the criminal law, a jail punishment is deserved, it is undoubted. On the other hand, for criminal’s social position, they are easy to receive harms and their legally right is easy to be infringement. Therefore, the protection of criminal right has a special significance, from this point, to protect criminal right is the human right safeguard last barrier. Only then criminal’s right obtains effective safeguard, all person’s human right have the final practical safeguard.
