摘要

南海问题是中国建设海洋强国过程中面临的历史性课题,仲裁结果加速了我国海洋维权与执法的重要性探究,海洋立法的缺失直接影响了执法的权威和效果,海洋执法体制改革的显著弊端,严重影响了海上维权执法的履行,对此,中国应借鉴国家先进经验,加速研究立法进程,不断深化执法体制改革,同时推动海峡两岸南海合作,共同维护海洋中华民族的海洋权益。
The issue of the South China Sea is a historic issue facing China in the process of building a maritime power, and the result of arbitration has accelerated China's maritime rights protection.And the importance of law enforcement, the lack of marine legislation directly affects the authority and effectiveness of law enforcement, marine law enforcement system reform.Leather significant and malpractice,has seriously,affected the implementation of maritime law enforcement rights, which, China should learn from the international advanced experience,Accelerate the study of the legislative process, deepen the reform of the law enforcement system, and promote cooperation in the South China Sea across the Taiwan Strait, and jointly safeguard.The Marine Rights and Interests of the Chinese Nation.
