南海仲裁案后南海人工岛礁的维权对策

摘要

2016年7月12日海牙国际仲裁法庭对南海仲裁案做出"最终裁决",判菲律宾"胜诉",并否定"九段线"。对于仲裁闹剧,我国始终坚持"不接受、不参与"的立场。仲裁案中菲律宾的一项重要诉求即否定我国在南海相关岛礁的法律地位,否定我国人工建设岛礁的行为。文章从分析南海人工岛礁法律地位入手,结合南海维权现实,探索南海人工岛礁维权对策。
On July 12, 2016, the Hague tribunal announced the result of South China Sea Arbitration: the Philippines "wins", and the "nine-dash" is invalid. Our country always adhere to non-acceptance of and non-participation in the arbitration. An important appeal in the arbitration is that the artificial reefs in the south China sea is illegal, the behavior of our country's construction is also illegal. This article begins from the analysis of the legal status of artificial reefs on the South China Sea, then explains the situation of the South China Sea. Finally, the article will explore the way to protect the rights of artificial reefs on the South China Sea.
