摘要

《中华人民共和国深海海底区域资源勘探开发法》于2016年5月1日正式实施。该法通过审议出台,对开展深海资源的挖掘、利用以及海洋环境的维护、大型活动的探测,制定了一定的规范章程。首先阐述中国在深海制度问题上的立场。再次,深层剖析《深海法》法制建设的意义,为中国深海资源勘探提出有力的法理依据。最后,通过《中华人民共和国深海海底区域资源勘探开发法》(以下简称《深海法》)与《联合国海洋法公约》(以下简称《公约》),从多角度提出中国对于深海资源勘探法制建设实用性的对策和建议。
The law of the People's Republic of China on the deep in the bottom of the sea area resources exploration Kai Fa Fa formally come into effect on May 1, 2016. The law through the review, to carry out deep sea area resources exploration, development and related environmental protection, science and technology research, resources investigation activities, establish a series of management system. First in this paper, the deep system's position in China. Once again, deeply analyzes the significance of the construction of legal system, the deep sea act to make a strong legal basis for China's deep-sea exploration. Finally, by the deep sea of the People's Republic of China in the bottom of the sea area resources exploration Kai Fa Fa(hereinafter referred to as the act of deep sea) and the UN convention on the law(hereinafter referred to as the convention), from the angles puts forward some countermeasures and Suggestions of China's response to this situation.
