摘要

伴随着中国内地与澳门地区民商事交往的日益密切,在交往中产生的与之相关的纠纷也不断增多。众多的纠纷解决方式中,仲裁因其具有的优点成为两岸民商事纠纷的一种重要解决方式。而裁决的认可与执行是仲裁制度的重要环节,对最终解决纠纷具有决定性意义。2007年出台的《关于内地与澳门特别行政区相互认可和执行仲裁裁决的安排》成为两地相互认可和执行仲裁裁决的主要法律依据,但经过10年司法实践,该安排存在的缺陷和不足逐渐凸显,与当前的实践需要不相符合。针对仲裁裁决范围、公共秩序保留、申请认可与执行的期限、法院审查的期限及法院拒绝认可与执行仲裁裁决的程序这几方面存在的问题展开分析,并在此基础上提出完善的建议。
        With the civil and commercial exchanges between Mainland China and Macao are increasingly close,disputes in the exchanges are also increasing.Among the dispute resolution methods,arbitration has become an important solution to the cross-strait civil and commercial disputes because of its advantages.The recognition and enforcement is an important part of the arbitration system,which is of decisive significance for the final settlement of disputes.The Arrangement for Mutual Recognition and Enforcement of Arbitral Awards between the Mainland and the Macao Special Administrative Region in 2007 becomes the main legal basis for mutual recognition and enforcement of arbitral awards between the two places.After nearly 10 years of judicial practice,the flaws in the arrangement are gradually highlighted.The paper analyzes the scope of the arbitration award,the public order reservation,the period of application for recognition and execution,the period of court review and the procedure of the court refusing to recognize and enforce the arbitration award.And on this basis,the paper puts forward proposals for improvenent.
