摘要

目前,在政府投资项目的工程建设过程中,由于不能严格履行建设程序而导致工程造价难以有效控制的现象仍然存在。所以工程建设管理者有责任和义务,努力研究履行建设程序方面存在的问题;分析由于不能严格履行建设程序而导致工程造价难以有效控制的现象,努力寻找解决的办法。文章对我国目前关于工程建设程序方面的有关规定和在履行建设程序方面存在的问题、政府投资项目工程造价难以有效控制的主要根源、以及解决建设程序问题的办法等进行了剖析。呼吁尽快以立法形式保障建设程序的顺利实施和监督执行。建议研究制定《政府投资项目建设程序管理法》,对工程建设全过程的建设程序进行约束和监督。使得在任何情况下,任何人都能严格按照建设程序组织工程建设,每个建设环节的建设程序都有相应的法律约束,最终通过严格履行建设程序实现依法管理政府投资项目工程造价的目标。因此,严格执行建设程序是有效控制政府投资建设项目工程造价的重要途径。
        There is still phenomenon that it is still difficult to effectively control the engineering cost due to impossible strict performance of construction procedures during construction process of government-invested projects. Therefore, the project construction manager has responsibility and obligation to study the problems in implementation of construction procedures. The following phenomenon is analyzed: it is still difficult to effectively control the engineering cost due to impossible strict performance of construction procedures. Current related regulations in China about engineering construction procedure and problems in performance of construction procedures, main causes why engineering cost of government-invested projects can not be effectively controlled, measures to solve problems in construction procedures, etc. are analyzed in the paper. It is suggested that smooth implementation and supervision execution of construction procedures should be guaranteed in the mode of legitimization. It is proposed that‘Methods for Management of Construction Procedures in Government-invested Projects' should be studied and formulated. The construction procedures of the whole process of project construction can be restricted and supervised. All people can organize project construction in strict accordance with construction procedures under all circumstances. The construction procedure in each construction link can be restricted according to corresponding law. The engineering cost of government-invested projects can be managed according to law through strict performance of construction procedures finally. Therefore, strict performance of construction procedure is an important approach to effectively control engineering cost of government-invested projects.
