我国环境保护产业发展的法律问题研究

摘要
在我国市场化经济的进程中，随着对环境问题认识的不断深入，在环境资源的保护和利用领域如何充分利用市场机制，实现在市场化条件对环境资源的产业化运作已成为社会经济生活中一个重要的经济现象。本论文从环保产业的概念界定入手，结合环保产业的发展现状，对环保产业的法律特性进行分析，并在借鉴国外先进经验的基础上，提出了我国环保产业的发展模式的构想。论文共分五个部分，包括环保产业概述、环保产业发展现状、环保产业法律特性分析、国外环保产业先进经验的借鉴和我国环保产业模式的构建。
第一部分、环保产业概述。通过对环境产业这一概念在内涵和外延方面作出明确限定，进而分析和论证该产业所具备的基本特征与属性，并从历史发展及产业自身的属性等方面论述环保产业产生发展的必然性。该部分还以我国环境产业的发展现状为基础，系统分析了环境产业发展对环境资源法的客观要求，为全文的理论推演奠定基础。
第二部分、环保产业发展现状。结合对国外环保产业现状的分析，对我国的环保产业现状及存在的问题进行分析。
第三部分、环保产业法律特性分析。环保产业本身属于产业的范畴，具备一般产业的基本属性。但是环保产业还具有其自身的特殊性。本文从环保产业的公共利益性(即外部性)、政府参与性和市场规律性对环保产业的法律特性进行分析。
第四部分、国外环保产业先进经验的借鉴。“他山之石，可以攻玉”，借鉴先进国家的发展经验对我国的环保产业的发展会产生积极的促进作用。欧洲的许多国家、美国、日本、加拿大是环保产业发达国家的代表，从对以上国家先进经验的探讨可以找到解决我国环保产业的发展模式问题的方案和途径。
第五部分、我国环保产业模式的构建。上个世纪九十年代以来，全世界兴起了环境保护的高潮，环保产业进入了快速成长的产业成长期，为使我国环保产业能在这良好的大环境下，抓住国内外环保市场需求剧增的发展机遇，经受住环保产业发达国家进入我国环保产业市场的严峻挑战，有必要提出我国环保产业今后应采取的发展模式。以下从产业主体模式、产业政策模式以及环保产业法律模式三个方面，来对构建这种模式进行深入的论述。
During the process of our country marketing reform, along with knowing to environmental problem more deeper, how to get good use of market mechanism in environmental protection and to realize environment and nature resources industry operating in the condition of market economy are becoming hot issue in the social economic realm.
Part 1 Brief Account of the Environmental Industry
To determine the concept of environmental industry in intension and extension, and then analyze the fundamental character of the industry. The chapter also expounds and proves the necessity of the arousing of environmental industry from the aspects of the background of the times and the goods attribute of environment and the related service.
Part 2 Developing state of environmental industry.
The analyses of recent state of environmental industry compared with that of foreign countries.
Part 3 Analyses of law attribute about Environmental industry.
Environmental production belongs to industry field which not only has general characteristic of industry but also has other special traits of itself. This part will analyze the law attribute of the public benefits (i. e. extension), participating of government, market regulation.
Part 4 Use for reference of foreign advanced experience.
Benefit from advanced experience is very important for promoting our environmental industry. Many European countries, America, Japan, Canada are representatives from which we can find out ways patterns to solve our problems.
Part 5 Pattern building of our environmental industry.
Since 1990s the world pay more attention to environmental protection. Environmental industry has entered growing stage. In order to catch market chance under a good condition and stand challenge of entry of foreign industry, it is necessary to put forward our developing patterns. Hereinafter are three
aspects to be discussed: Industry major pattern, Pattern of industry policy as well as law of environmental protection.
