论提单权利的法律性质

摘要
提单，被公认为是国际货物运输中最为重要的单证，而研习提单权利属性以及提
单法律制度亦成为攻读、研究海商法者的第一要义。本文通过对提单所体现的财产权
利内涵及提单和权利之间的关系进行研究，并以民法中物权和债权概念作阐述，指出
提单作为权利凭证体现为其占有权凭证的功能，认为提单是一种广义上的有价证券。
此外，本文确认信用证下银行对提单担保享有质权。
Since Bill of Lading is regarded as the most important document of the
international cargo transportation, research and study on the legal system of Bill of
Lading is also regarded as the main point of studying maritime law. This
dissertation is mainly on legal qualities of Bill of Lading, hereby referred to as
substantive title, which means indirect possession of the goods and ostensible title,
which is some kind of value document. Besides, it also deals with the study of the
pledge function of the Bill of Lading when used in the Letter of Credit practice.
Based on above research and study, some opinions and suggestions are put
forward accordingly.
单法律制度亦成为攻读、研究海商法者的第一要义。本文通过对提单所体现的财产权

Since Bill of Lading is regarded as the most important document of the
