论法与习俗的协同
摘要
法与习俗的相互关系问题，是我国法学理论中的一个崭新的课题。自20世纪90年代开始，部分学者从不同的角度逐渐转向对该问题的研究，并对之作了较为肯定的评价。然而，就目前学界研究现状看，一般以研究习俗、习惯法居多，而深入研究法与习俗的相互关系，尤其是当代中国法治建设过程中法与习俗的相互关系者较少。本文认为，法与习俗的相互关系，是现代法学理论中的基础性问题，是我国法治目标的确立以及法的制定和实施的重要依据。本文立足于法与习俗的现实，运用逻辑和历史相结合的方法，阐述法与习俗协同的必然性，并且以实证的方法证明，法与习俗的协同是当前我国建设社会主义法治国家的重要途径，它对推进我国新时期的法治建设，具有重大的现实意义。
本文共分三个部分。第一部分是对资产阶级学者关于习俗理论进行评介，并指出了他们理论中的合理因素与不足，从而初步归纳出本文有关习俗的定义。
文章第二部分主要论述了法与习俗之关系的理论与现实。首先是论述马克思主义关于法与习俗的一般理论，接着是从法的进化和法的实现两个角度论述法与习俗协同的理论意义和实践价值。
文章第三部分主要提出对实现法与习俗协同的法理学思考和建议。本部分通过对法与习俗的历史考察，得出我国历史上不同时期法与习俗之间不同关系的结论。最后，针对当前我国在法与习俗的协同中出现的问题，笔者着重从我国的法治目标、法的制定以及法的实施三个方面提出了一些对策和建议。
The correlation between law and custom is a brand-new subject in China' s law theory. Since the beginning of 1990' s, some scholars gradually turn to do some research on the subject from various angles and make a definite evaluation. However, as things are at the moment in jurisprudence, most of the scholars are studying only on custom or customary law, and less of them on the correlation between law and custom, especially in the process of the construction of rule of law in China. The article considers that the correlation between law and custom is a basic theory issue in law theory and an important basis of establishment of object of rule of law and its formulation and enforcement in our country. The article bases on the reality of law and custom, explicates the inevitability of coordination of law and custom with the means of joining of logic and historicity, and demonstrates that the coordination of law and custom is the important road of building our socialistic country of rule of law with factually way
at present, and it has a magnificent practical meaning on improving construction of rule of law during new period of China.
The article consists of three sections. The first section
comments on the points of view of the custom of capitalistic scholars, and points out the factors of reasonableness and unreasonableness in their theories and concludes tentatively my own definition of custom.
The second section mainly illustrates the theories and realities of the relationship between the law and custom, it deals with the Marxist theory of law and custom first and with the theoretical meaning and practical value of coordination of law and custom from the aspects of evolution and realization of law later.
The third section puts forward jurisprudence thought and suggestion on carrying out the coordination of law and custom. The author concludes there are different relations between law and custom at the different stages in China' s history through the inspection to history of law and custom in this section. Finally, it puts forward some countermeasure and suggestion on the coordination of contemporary law and custom especially on object of rule of law and its formulation and enforcement in China.
