摘要
2010年11月26日最高人民法院发布的《最高人民法院关于案例指导工作的规定》,拉开了我国指导性案例制度建设的序幕。截止目前,最高人民法院已累计发布7批共计31个指导性案例。我们希望从最高法院建设的这一制度获得灵感,在烟草专卖行政执法中建立烟草系统自己的指导性案例制度。我们从构建的法渊方面确定构建的合法性,通过分析与判例法、自由裁量权和省局编著的《烟草专卖办案实用指南》的不同以及现行执法依据存在的不足来确定构建的必要性,从发布主体、发布程序和公布形式等方面简单说明构建方式。
November 26, 2010 the Supreme Court issued the "Supreme Court rules on the case to guide the work," kicked off our guiding case system construction, until now, the Supreme Court has issued a total of seven batches totaling 31 guiding case. We hope to get inspiration from the Supreme Court building this system, the establishment of tobacco system's own guidance system in the case of the tobacco monopoly law enforcement. We determine the legality of building constructed from deep respect law. Through analysis and case law, discretion and the provincial bureau compiled the different and the current lack of enforcement based on the existence of "Tobacco Monopoly investigators Practical Guide" to determine the need to build. From publishing the subject, publishing and other aspects of the program and released in the form of a brief description built.
