城市边缘区海域管理困境与对策——以大连市黄泥川村为例

摘要
城市边缘区的海域使用面临着由传统渔业、养殖业向非农利用方式转换,各种矛盾冲突集中凸显。海域确权法律规定不完善、海域使用规划与现有海域使用方式存在冲突,带来了海域管理困境。大连市黄泥川村海域使用中的不合理现象,反映出海域管理面临的法律、制度障碍。在海域管理制度逐步完善进程中,地方政府可以采取颁发临时海域使用证、给予村民社会保障和就业机会、布点海域管理专门机构等措施,从操作层面解决海域管理的突出问题。
The sea area in urban fringe are in the midst of transition from traditional fishery and breeding industry to the non-agricultural industries,which brings about a lot of contradictions and conflicts. The imperfect laws and regulations on confirming the right of sea area and the conflict between the use planning of sea area and the current utilization of sea area have caused dilemma for managing the sea area. The irrational phenomena in the use of sea area at Huangnichuan Village of Dalian City reflect the legislative and institutional obstacles in the management of sea area in urban fringe. In the course of gradual perfection of management system of sea area in urban fringe,such countermeasures as issuing temporary use certificate of sea area,providing villagers with more social securities,increasing opportunities to work at the local area and outside and stationing specialized agencies to manage sea area should be taken to operationally solve the prominent problems in management of sea area in urban fringe.
