中国企业投资阿富汗的劳工法律风险防范分析

摘要
劳动及用工法律对于国家的稳定发展起着积极作用,劳工法律制度的存在有利于劳动者得到充分就业,保障劳动者合法权益。本文结合了中国企业在阿富汗投资现状以及阿富汗劳工法律体系,分析了中国企业投资阿富汗所面临的劳工法律风险,笔者认为风险点存在的主要原因是中国企业缺乏对阿富汗国家的劳工法律法规的全方位认识,从而导致中国企业的用工模式与阿富汗劳工环境呈现出水土不服的现象。为了规避这样的法律风险,本文提出了相应的对策措施。
The long-run development of the whole country can be realized with the advanced labor and employment laws. The existence of the labor legal system benefits for the laborers' full employment and the protection of the workers' lawful rights and interests. Based on the investment status of Chinese enterprises in Afghanistan and its labor law system,the author analyzes the laborer law risk of Chinese Enterprises investing in Afghanistan and thinks the main reason for the risk is that Chinese enterprises do not have a full understanding of the labor laws and regulations of the Afghanistan,resulting in the mismatch between Chinese enterprises' management and Afghanistan's labor environment. In order to avoid such kind of risks,the author puts forward several countermeasures for Chinese enterprises to improve adaptability.
