摘要
转基因技术通过将人工分离和修饰过的基因导入生物体基因组中,带来更优的生物体遗传性状,同时也带来对其安全性的连绵争议。文章对我国转基因生物、食品管制的立法框架及其研制、生产、市场化管制的组织架构和我国转基因食品安全的法律责任规定进行了系统梳理,并从美国S.764法案中得到启示,以期对我国转基因生物、食品建立更加完善的规制体系。
While the genetically modified technology has brought the better hereditary characteristics on the biologics,it has also led to a continuous debate on its safety by integrating the genes obtained after its intentional separation and modification by researchers into the biologics. This article has made a complete study on the GMO,the legal framework of regulations,the organization structure of research on production,management of marketing and the legal liabilities concerned with the safety of GM food in China. Part of the inspiration in this article comes from the newly passed Act S. 764 in America. The aim of this article is to help China to establish a better regulatory framework on GMO and GM food.
