公共有声数字图书馆合理使用分析——以《马拉喀什条约》及视障群体参与全民阅读为视角

《马拉喀什条约》生效已近3年,我国《公共图书馆法》已实施近一年。前者明确倡导公共图书馆参与实现视障群体之人权,后者明确规定公共图书馆推动、引导并服务于全民阅读。接触作品是阅读的前提和基础,有声读物是视障群体接触作品的最便捷方式,公共图书馆有义务提供充足的有声读物资源。然而,著作权在一定程度上阻碍了公共有声数字图书馆制作及传播数字有声读物。文章以《马拉喀什条约》的落实及视障群体参与全民阅读为视角,论及公共有声数字图书馆合理使用正当性问题,理论与实践意义并重。
At present,nearly 3 years after the entry into force of the Marrakesh Treaty,our Public Library Law has been in operation for almost a year.The former explicitly advocates the participation of public libraries in the realization of the human rights of visually impaired groups,while the latter clearly stipulates that public libraries promote,guide and serve the reading of the whole population.Access to works is the premise and foundation of reading,audiobooks are the most convenient way for visually impaired groups to come into contact with works,and public libraries have an obligation to provide adequate audio reading resources.However,copyright has hindered the production and dissemination of digital audiobooks in the public audio digital library to a certain extent.From the perspective of the implementation of the Marrakesh Treaty and the participation of visually impaired groups in universal reading,this paper discusses the legitimate use of public audio digital library,both theoretical and practical significance.
