博士硕士学位授权审核的行政法规制

摘要
《博士硕士学位授权审核办法》的颁行,是深化行政审批制度改革的有益探索,体现出对高校办学自主权的尊重和多元主体社会共治模式的创新。新一轮博士硕士学位授权审核的新政,整体上呈现向行政许可属性的回归、过程的法制化和结果的审慎化等特点。学位授权审核制度的进一步改革,需要坚持许可辅助性原则和动态调整理念,实现从行政导向到学术导向、从规则导向到需求导向的转变;在授权审核权限的配置上,需要通过修订《学位条例》为省级学位委员会正名,并就授权审核中的专家评议和论证规则作出专门规定;在规制手段的更新上,需要大力推广过程信息监管和学位论文抽检,使其成为学位授权审核事中、事后的新型规制手段。
The promulgation of Measures for the Approval of the Grant of the Doctor and Master's Degree is a useful exploration for deepening the reform of the administrative approval system,which reflects the respect for the autonomy of universities and the innovation of the co-governance model of multi-subject society.The practice of the new round of the approval of the grant of degrees shows that it returns to the attributes of administrative approval,and legislation of process and prudence of results.The further reform of the system of the approval of the grant of degrees needs to adhere to the principle of approval subsidiarity and the concept of dynamic adjustment,and realize the transformation from administrative orientation to academic orientation,from regulation orientation to demand orientation.In the respect of the configuration of the approval right,it is required to amend Regulations on Academic Degrees to reform provincial academic degree committees,and promulgate special provisions on expert evaluation and demonstration rules in the approval of the grant of degrees.In the respect of regulation methods,it is required to widely promote process information supervision and dissertation sampling inspection,which will become new regulation methods in and after the approval of the grant of degrees.
