高校大学生实习权益的法律保障制度研究

摘要

我国每年的实习生数以百万计,其权益保障问题亟待解决。目前理论界对实习生与实习单位之间是否具有劳动关系存在争议,司法实务在法律适用方面存在不一致情况。界定实习生与实习单位的法律关系、探索实习权益的法律保障制度可从大学生实习分类的角度出发,运用法律要件体系标准准确定性法律关系,正确适用法律,并可进行拓展延伸考虑实习权益法律保障的立法完善。
        There are hundreds of thousands of trainees each year and their protection of rights and interests turns out to be an urgent problem to be solved. At present there are controversies about whether there is labor relation between the trainees and their practice units, and there is disagreement between judicial practice and application of law. To define the legal relationship between interns and internship units and explore the legal protection system of the rights and interests of university students' internship may start from the perspective of the internship classification of university students, apply the standard of legal requirement system to determine the legal relationship and apply it in a correct way. Finally some suggestions are proposed with regards to the legislative improvement of the legal protection of rights and interests about internship.
