摘要
目前肆虐微信平台的诱导分享行为,其实质在于非法获取用户个人信息。微信平台作为网络运营者,基于网络安全保障义务,对于此类有害信息具有信息规制权。现行微信平台的管理措施主要为事后补救措施,为加强个人信息保护,微信平台应当转变规制理念,在技术服务,实名制注册,规范有奖活动,风险提示以及人工客服五个方面加强对于微信诱导行为的事前防范。
At present,the inductive sharing behaviors on the WeChat platform is riddled with the illegal acquisition of personal information of users. As a network operator,the WeChat platform has the right to regulate such harmful information based on network security obligations. The management measures of the current WeChat platform are mainly post-remediation measures. In order to strengthen the protection of personal information,the WeChat platform should change the regulatory concepts,and strengthen the WeChat-inducing behaviorsfrom five aspects: technical service,real-name registration,standardized reward activities,risk warning,manual customer serviceand other pre-emptive preventions of WeChat-induced behaviors.
