云南省农村宅基地流转法律制度的建构

摘要

宅基地使用权制度是具有中国特色的一项物权制度,关乎农民的切身利益,是保障农民居住条件的重要举措。目前,我国欠缺关于宅基地流转的法律规定,缺乏良好的法治环境来保障宅基地的有序流转。因此,构建合理的云南省农村宅基地使用权流转法律制度对确保市场有序、保障交易安全、维护农民的合法权益至关重要。本文结合前期的调研实状和大理市的试点经验,主要从修改现行法律、完善登记和农村社会保障制度等方面提出建议,以期能对建构云南省农村宅基地使用权流转的法律制度提供参考。
        The homestead system in China,specially with Chinese characteristics,concerns the vital interests of farmers and it is an important measure to guarantee the living conditions of the peasants. At present,China lacks the legal provisions concerning the transfer of homesteads and lacks a good legal environment to ensure the transfer of rights to use homestead. But the construction of a reasonable legal system for the transfer of the right to use rural residential land is crucial to ensuring market order,transaction security,and protecting the legitimate rights of the peasants. Therefore,based on the previous research facts and the pilot experience of Dali City,this paper proposes suggestions on aspects such as amending the existing laws,improving registration and rural social security systems,so as to provide reference for the construction of a legal system for the transfer of rural residential land in Yunnan Province.
