民国初期法律家群体研究(1912-1927)

摘要
民国初年,一批着力于中国法制近代化的法律家大量涌现,形成了近代中国颇具规模的法律家群体。法律家群体的出现,促进了近代中国的法学研究、法学教育、司法改革、法律发展和中国近代法学体系的创建,它在多个层面上体现着中国社会的现代意义。对这一群体的一些基本问题——如群体的界定、出现的原因、年龄和性别结构、区域分布及留学经历、角色意义——进行分析,对于我们更好地认识当时中国法制近代化发展的状况,以至对研究近代中国政局走向都有着重要的意义。
In the early time of the Republic China, a great number of legists who dedicated to the modernization of Chinese legal system were emerging in multitude, and thus formed a legist community with considerate scale in modern China. The emergence of legist community promoted the jurisprudence study,jurisprudence education, judicial reformation, law development and Chinese modern jurisprudence system's establishment, which embodied the modern significance of Chinese society in many aspects. It is helpful for us to cognize the current development state of Chinese legal system modernization and of important significance on researching the developing direction of modern Chinese political situation for making a analysis on several basic issues of the legist community, such as the community's definition, the reason of its emergence, the structure of the age and the gender, the area distribution, the experience of studying abroad and the role's significance.
